BOARD
DECLARES GLOBAL A COMMON EMPLOYER On Friday,
December 3, 2004 the Canadian Industrial Relations
Board issued a brief ruling in which it “determined
that the evidence supports a conclusion that various
Global television stations which were the subject of
this application, operate as a common employer as
contemplated by section 35 of the Code” The CEP had
applied for a common employer declaration from the
Board based on its view of the way CanWest Global
manages its television operations and that the
employer is CanWest Global. The Board has now agreed
with this view. There has been a lot of reaction to
the Board’s determination. CEP National
Vice President for Media Peter Murdoch said "Now
that the board has ruled, we will be able to
bargain one collective agreement for all the
employees we represent across Canada," CEP Legal
Counsel Dan Rogers remarked, “While the reasons
for the ruling are not known yet, what we know
for certain is that the labour relations status
quo has been rejected as the Board concluded that a
common employer had been established."
CEP National Representative Rob Lumgair stated, “A
great deal of work has been done by a number of people toward this
determination. To all of them I express my thanks. We look forward
to the continued support of all of members of
GAC.” The Global Advisory Council is satisfied
with the determination of the board. Kevin Hagglund, the chair
commented, “The CIRB’s determination is the continuation of the
process we started over 3 ½ years ago. We are
looking forward to the next phase and ultimately
bargaining a fair and just collective agreement for all of our
members from Halifax to Victoria.” The board has ordered the
company and union to start the process of
determining the scope of the bargaining unit.
“It is the Board’s intention to review the bargaining unit structures
under at least section 35 and possibly other
sections of the Code.” If you have any questions

COMMITTEES FOR LOCAL
815M
We have struck several committees in order to serve our local better. Each
committee will be represented by 3 members.
Sponsorship-Charity:
Jennifer Crosby, Bret Ballast
Will be in charge of creating ways to help those in need. Also, if any
member has an idea for a way in which we can help an organization, team or
person, this would be the committee to approach. There are two people on
this committee, one more person to add to this list would be great. We
have a slate of things we contribute to on a regular basis including the
Labour Council Picnic in September and Remembrance Day Wreaths.
Education:
Bob Kearney, Peggy Heyer
The education committee has been around for a while yet the education fund
is under-utilized! The education fund is supported by both the company and
the union. If you are Full-Time, you can benefit from this education fund.
Whether it is a course in which you are interested or some form of
educational upgrading, speaking to someone on the education committee is
your first step.
Social:
Di Sawyer, Stacy Ross
This is a new committee that will help us co-ordinate social events for
our local. This committee will be responsible for arranging our General
Meetings and other social activities.
Pension:
Rick Wormald, Bob Kearney
This committee will have relevant information on our pension status plan
and will keep track of the progress of the pension plan. Anyone interested
in rounding out this committee to three people, please put your hand up!
Grievance:
Scott MacDougall, Kim Emerson
The grievance committee is responsible for taking grievances from start to
finish. The grievance procedure can be found in the contract. If a
grievance needs to be filed, then the committee will help members to do
that and support them through this process.
Reclassification:
Frank Smith, Bob Kearney, Dana Hutchings, Murray Langdon The
reclassification committee will meet from time to time to assess job
classifications as needed. If someone is interested in having their job
reclassified, then a request in writing should be made to this committee.
Bylaws:
Brian Graham, Dana Hutchings
The bylaws of Local 815M will require the occasional re-adjustment as time
goes by and this committee will make sure our bylaws are current and
relevant.
Communications:
Jenny Matechuk
The communications committee is a means of helping Local 815M relay
important messages to our members about events, situations, news and
anything that matters to our members.

Our contract stays the same. We have
a three year deal with a total of 7.5% wage increase.
Our new contract expired on February 28,
2007.

CEP SCHOLARSHIP PROGRAM
Twelve scholarships worth $2,000 each in honor of L.H. Lorrain, George
Hutchens, Evelyn McGarr and Peter Klym are each year made available to
members and children of members pursuing full time post-secondary
education at a recognized institution such as university, college, CEGEP,
technical or other schools.
The scholarships are available to students who HAVE COMPLETED THEIR
SECONDARY STUDIES (11th or 12th grade, Secondary V) and enter or undertake
POST-SECONDARY STUDIES at college, university, CEGEP or technological
institutes. The following applicants are
eligible:
- CEP members in good standing;
- Children of CEP members in good standing;
- Children of CEP members who passed away while in good standing;
- Children of CEP members who retired in good standing.
The selection of successful applicants will be made by a person appointed
by the President on behalf of the Executive Board. Selections made by that
person will be final.
Applicants must complete the attached CEP scholarship form, have it signed
by a CEP Local Union Officer and send it to Communications, Energy and
Paperworkers Union of Canada (Scholarships), 350 Albert St., Suite 1900,
Ottawa, ON K1R 1A4. The applicant must also submit with the application an
essay of 1,500 to 2,000 words on the
topic: "What the labour movement means to me" no later than March 31,
2004.
The application form must also be accompanied by the most recent student
transcript of the applicant.
There will be no acknowledgement of receipt but all the applicants will be
contacted at the end of August or very early in September to let them know
whether they have been chosen for an award or not.
The successful candidates will meet with an officer of the Communications,
Energy and Paperworkers Union or such person delegated by him, to finalize
all financial arrangements and make provisions for a review of a mid-term
progress report.
